01Acceptance of These Terms

Welcome to the website of Elite Shilajeet (“Elite Shilajeet”, “we”, “us” or “our”). These Terms and Conditions (“Terms”) govern your access to our website and the purchase of any product from us. By browsing the website, creating an order or making a payment, you confirm that you have read, understood and agreed to these Terms, our Privacy Policy, Shipping Policy and Return & Refund Policy.

These Terms form a legally binding electronic agreement and are recognised as such under the Electronic Transactions Ordinance, 2002 of Pakistan. If you do not agree with any part of these Terms, please do not use the website or place an order.

03Eligibility

You may place an order only if you are at least 18 years old and legally capable of entering into a binding contract under the Contract Act, 1872. Our products are not intended for children. If you buy on behalf of another person or a company, you confirm you are authorised to do so.

You agree to provide accurate, current and complete information (name, address, phone number and email) when ordering, and to keep it up to date.

04Products and Descriptions

We try to describe and display our products as accurately as possible, including sizes, formats and images. Product photos and artwork are illustrative, and the packaging may change slightly between batches. Natural products such as Shilajit can vary in colour, texture and aroma from batch to batch, which is not a defect.

Our current range includes Shilajit resin (50g and 100g), liquid drops (30ml) and a resin and drops bundle. We may add, change or discontinue products at any time. Availability is subject to stock.

06Orders and Contract Formation

Placing an order is an offer to buy. A binding contract of sale under the Sale of Goods Act, 1930 is formed only when we confirm your order by email, SMS, WhatsApp or by dispatching the goods. We may decline or cancel an order, for example because of stock shortage, a pricing or description error, a suspected fraudulent order, or an address we cannot deliver to. If we cancel a prepaid order, we will refund the amount in full.

We may contact you by phone or message to confirm an order, particularly for cash on delivery orders, before dispatch.

07Prices and Taxes

• Prices are shown in [Pakistani Rupees (PKR) / US Dollars (USD)] and may change without notice. The price at the time of your order confirmation applies.
• Prices include or exclude applicable taxes as shown at checkout. Where sales tax or other government levies apply under Pakistani law, they are added as required.
• Delivery charges, where they apply, are displayed before you confirm the order.
• For international orders, customs duties, import taxes and clearance fees of the destination country are the buyer’s responsibility.
• If we find a pricing error after you order, we will tell you and give you the choice to confirm at the correct price or cancel for a full refund.

08Payment

We accept the payment methods shown at checkout, which may include cash on delivery (within Pakistan), bank transfer, mobile wallets and debit or credit cards. Electronic payments are processed through licensed payment providers in line with the Payment Systems and Electronic Fund Transfers Act, 2007. We do not store your full card details on our servers.

• For prepaid orders, we dispatch after payment is confirmed.
• For cash on delivery, payment must be made in full to the courier at delivery. Repeated refusal of confirmed orders may lead us to require prepayment on future orders.
• If a payment fails, is reversed or is found to be fraudulent, we may cancel the order.

09Shipping and Delivery

We ship through third-party couriers within Pakistan and, where available, internationally. Estimated delivery times are shown at checkout or on our Shipping Policy and are estimates only, not guarantees. Delays can arise from weather (including road closures in mountain regions), courier operations, security situations, public holidays or customs.

• Risk in the goods passes to you on delivery. Please check the parcel on receipt.
• If a parcel appears damaged or tampered with, record it (photo or video) and contact us within 48 hours of delivery.
• We are not responsible for delays or failed delivery caused by an incorrect or incomplete address or an unreachable phone number provided by you.

10Returns, Refunds and Cancellations

Because Shilajit is a consumable product, returns are limited for hygiene and safety reasons. This section is in addition to any rights you have under applicable consumer protection laws in Pakistan, which are not excluded by these Terms.

• Cancellation: you may cancel an order before it is dispatched by contacting us. Dispatched orders cannot be cancelled.
• Wrong, damaged or defective items: contact us within [7] days of delivery with your order number and clear photos or video. We will replace the item or refund you, at your choice, once the claim is verified.
• Change of mind: unopened and sealed products in original condition may be returned within [7] days of delivery. Return delivery cost is borne by the buyer unless the item was wrong or defective. Opened or used products cannot be returned.
• Refunds are issued to the original payment method, or by bank or wallet transfer for cash on delivery orders, within [7–14] working days after we receive and inspect the returned item.

11Product Quality and Lab Reports

We source raw Shilajit from Gilgit-Baltistan and prepare it using water-based purification. We send batches to independent laboratories and publish reports where available. Laboratory scope and results can differ from batch to batch, and reports relate only to the batch tested. Lab reports are provided for transparency and are not a promise of any health benefit.

12Intellectual Property

All content on this website, including the Elite Shilajeet name, logo, text, graphics, product images, design and layout, is owned by or licensed to us and protected under the laws of Pakistan, including intellectual property laws. You may view and print pages for personal, non-commercial use. You may not copy, reproduce, modify, distribute or use our content or brand for commercial purposes, including on other websites, marketplaces or social media shops, without our written permission.

13Acceptable Use

You agree not to:

• use the website for any unlawful, fraudulent or abusive purpose, or in breach of the Prevention of Electronic Crimes Act, 2016;
• attempt to gain unauthorised access to our systems, interfere with the website, or introduce viruses or malicious code;
• use bots, scrapers or automated tools without our permission;
• submit false orders, false payment details or false claims of damage or non-delivery;
• post false, defamatory or misleading reviews or content about us or our products.

We may suspend or block access and report unlawful activity to the relevant authorities, including the FIA Cyber Crime Wing.

14Privacy and Personal Data

We collect only the personal data needed to process your order, deliver it, provide support and meet legal obligations, such as your name, contact details, delivery address and order history. We do not sell your personal data. We share it only with service providers who help us run the business (for example couriers and payment providers) or where required by law. We take reasonable steps to protect your data in line with applicable Pakistani law, including the Prevention of Electronic Crimes Act, 2016. 15Limitation of Liability

To the fullest extent permitted by the laws of Pakistan:

• the website and its content are provided on an “as is” and “as available” basis, and we do not guarantee that it will always be uninterrupted or error-free;
• we are not liable for indirect, incidental or consequential loss, or loss of profit or opportunity, arising from the use of the website or products;
• our total liability for any claim relating to an order will not exceed the amount you paid for that order;
• we are not liable for harm resulting from misuse of a product, failure to follow the usage guidance, or failure to consult a healthcare professional where advised.

Nothing in these Terms excludes or limits liability that cannot be excluded by law, including liability for fraud or for death or personal injury caused by our proven negligence, or your statutory consumer rights.

16Indemnity

You agree to compensate us for loss, claims or expenses (including reasonable legal costs) that result from your breach of these Terms or your unlawful use of the website.

17Force Majeure

We are not responsible for delay or failure to perform caused by events beyond our reasonable control, including natural disasters, landslides or road blockages, floods, severe weather, strikes, government orders, internet or power failure, courier disruption, war, civil unrest or pandemic restrictions. We will inform you of significant delays and, where we cannot fulfil your order, refund any amount paid for it.

18Governing Law and Disputes

These Terms are governed by and interpreted in accordance with the laws of the Islamic Republic of Pakistan.

• Step 1: talk to us. Please contact us first so we can try to resolve the issue informally, usually within 15 working days.
• Step 2: formal resolution. If we cannot agree, the dispute may be referred to arbitration under the Arbitration Act, 1940 [optional: seat in Skardu, one arbitrator, English or Urdu], or to the courts.
• Jurisdiction. Subject to any mandatory consumer rights, the courts at [Skardu, Gilgit-Baltistan] have exclusive jurisdiction.

Consumers may also use any complaint channel or consumer court available under the consumer protection laws that apply to them.

19Changes to These Terms

We may update these Terms from time to time to reflect changes in our business or the law. The updated version will be posted on this page with a new “Last updated” date. Orders are governed by the Terms in force when the order was placed. Continued use of the website after changes means you accept the updated Terms.
